Official Rules for the Alliance Parts Richard Petty Driving Experience Sweepstakes

NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. LIMIT ONE ENTRY PER WEEK, PER PERSON/E-MAIL ADDRESS. ONE WINNER PER HOUSEHOLD.

SWEEPSTAKES PERIOD: The Sweepstakes will begin on November 2, 2009 and end on November 29, 2009. One prize will be awarded each week.

ELIGIBILITY: The Alliance Parts Richard Petty Driving Experience Sweepstakes ("Sweepstakes") is offered and is open only in the United States and District of Columbia to natural persons age 21 and older who are legal U.S. residents as of the date of entry. Employees of Daimler Trucks North America LLC ("Sponsor") or its affiliated companies, agents, advertising and promotion agencies and their employees, and the immediate family members of all such employees are not eligible to enter. To be eligible to win the Grand Prize entrants must have a valid commercial driver's license. Sweepstakes are subject to all federal, state and local laws and regulations. Offer void in Florida, New York, Rhode Island and where prohibited.

TO PARTICIPATE: Visit www.alliancebrandparts.com/sweepstakes to fill out an entry form. Entries must be received by 12:00 a.m. EDT each Sunday during the Sweepstakes Period to participate in that week's drawing. Sponsor is not responsible for any lost, late, delayed, misdirected, or incomplete entries or for any technical problems in connection with transmission or receipt of entries, including faulty electronic data transmission, traffic congestion on the Internet or the Web site, hardware or software error, equipment failure or malfunction, or other online communications problems. Subject to all federal, state, and local laws and regulations. Incomplete entries will be rejected. No other attempted methods of entry will be accepted.

PRIZES: The following prizes will be awarded. Prizes are not transferable and are not redeemable for cash or credit. Sponsor reserves the right to substitute a prize of equal or greater value if stated prize becomes unavailable for any reason.

• Four (4) Grand Prizes (one per week): a Richard Petty Driving Experience Gift Card (Approximate Retail Value $500.00)

DRAWING: A winner will be selected in a random drawing to be conducted on the Monday following each full week during the Sweepstakes Period. Non-winning entries will be included in the remaining drawings during the Sweepstakes Period. Odds of winning depend on the number of eligible entries received. Prize winners will be notified by phone or email.

GENERAL CONDITIONS AND LIMITATION OF LIABILITY: By participating in this Sweepstakes, participants agree to be bound by the Official Rules and the decision of the Sponsors. Limit one entry per person during the Sweepstakes Period. All entries become the property of Sponsors and will not be returned. Persons who tamper with or abuse any aspect of this Sweepstakes, as solely determined by the Sponsor, will be disqualified. Sponsor is not responsible for lost, late, misdirected, incomplete, or non-delivered entries or other information failure to capture, or loss of, any such information.

By accepting a prize the winner agrees that Sponsors, their parents, affiliates or subsidiaries, advertising and promotional agencies, and each of their respective officers, directors, and employees, will not be held responsible for and shall be held harmless from and against any damage, loss of property, other loss, liability, claim, accidents, injuries or death that may occur in the participation in this Sweepstakes, the receipt of, or the awarding, acceptance, use, misuse or possession of prizes or any travel related thereto. Except where prohibited by law, participants agree that winner grants permission to Sponsors the right to the use of winner's name and likeness in advertising and promotion without further compensation or permission, and further agree to sign and return, within 14 days of notification: (a) an Affidavit of Eligibility and Release of Liability; and (b) a publicity release. If prize notification letter or the prize is returned as undeliverable, the prize will be forfeited and Sponsors may award the prize to an alternate winner. Failure to return affidavit and release within the specified timeframe will result in forfeiture of prize and may result in the prize being awarded to an alternate winner. All taxes on prizes are the sole responsibility of the winner. Limit one prize per household or address.

DISPUTE RESOLUTION/ARBITRATION/CHOICE OF LAW: Except where prohibited agree that : (1) any and all disputes, and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, or the determination of the winnings, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the rules of the American Arbitration Association, then effective, and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket cost incurred, including cost associated with entering this Sweepstakes but in no event attorneys' fees; and (3) under no circumstances will participants be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and/or Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of Oregon, without regard for the conflicts of law doctrine of that State or any other jurisdiction, and all proceedings shall take place in the State of Oregon.
